In all matters connected with water and drainage works the said Francis Alfred Cooper shall be considered to be a Head of a Department corresponding direct with the Government, and other Heads of Departments in accordance with the rules of the Public Service of Hong Kong and all his proceedings thereat shall be subject to the general control of His Excellency the Governor as in the case of the Head of a Department. He shall correspond with the Consulting Engineer, when the latter is absent from Hongkong, through the Colonial Secretary under flying seal.

The said Francis Alfred Cooper shall have

the entire control and direction of all persons employed on the works, whose remuneration shall be charged to the said works, and of any persons temporarily appointed to assist him from other departments and shall in his own name on behalf of the Government engage at such salaries as may be approved by the Governor and dismiss at pleasure without any reference to the Government all foremen, clerks and employés other employés of whatever description except those who were in the employment of the Colonial Government previous to the 1st December one thousand eight hundred and eighty-nine and such other Officers as are or may be duly appointed by the Government of Hongkong, to serve in this department. In all matters relating to the payments or the granting of contracts the said Francis Alfred Cooper shall have the same status as the Surveyor General has in regard to other public works.
